What is a Last Will and Testament?

A Last Will and Testament is a legally binding document that dictates how your estate (your property, finances, and personal belongings) will be managed and distributed after your death. It also allows you to appoint an Executor to handle your affairs and name legal guardians for your minor children.

If you pass away without a valid Will (known as dying “intestate”), your estate will be divided according to the strict formulas set out by the Succession Law Reform Act of Ontario. This can lead to costly delays, unnecessary taxes, and outcomes that do not align with your actual wishes.

Drafting vs. Witnessing Services

We tailor our services to fit your specific estate planning needs:

Witnessing & Notarizing Only

If you have already drafted your own Will (via an online will kit, a lawyer, or a digital platform), we can act as the official, independent witnesses to ensure the signing is executed in full compliance with Ontario law. We also draft and commission the mandatory Affidavit of Execution, which your Executor will need for probate.

Custom Will Drafting

If you do not have a Will, our legal professionals will consult with you to understand your assets and family dynamics, and draft a customized, legally robust Last Will and Testament tailored specifically for you.

Your Pre-Visit Checklist: What to Bring

Because a Will dictates the transfer of your life’s assets, strict legal formalities must be followed during signing:

The Unsigned Will

If you are bringing your own drafted document, it must be completely filled out but left unsigned. By law, you must sign the Will in the simultaneous physical presence of two witnesses.

Valid Government Photo ID

You must present an unexpired, government-issued photo ID (such as a Driver’s License, Passport, or Ontario Photo Card).

Two Witnesses (Crucial)

Ontario law requires a Will to be signed in front of two eligible witnesses. Our Notary Public can serve as one witness. You can bring a trusted friend or colleague as the second, or our office can provide a second witness for a small additional fee. (Note: Anyone named as a beneficiary in your Will, as well as their spouse, is strictly prohibited from acting as a witness).

Frequently Asked Questions

Yes, it is highly recommended. An Affidavit of Execution is a sworn statement made by one of the witnesses to your Will, confirming they watched you sign it. When you pass away, your Executor will need this affidavit to apply for probate. We draft and commission this affidavit as part of our Will witnessing service, saving your Executor massive headaches down the road.

No. Only you (the "Testator") and your two witnesses need to be physically present during the signing.

A Will that is entirely handwritten and signed by you (a "Holograph Will") is legal in Ontario without witnesses. However, if even a single word is typed or pre-printed, it must go through the formal two-witness signing process to be legally valid. Holograph wills are often challenged in court due to vague wording, making professionally witnessed Wills the safest route.
