What is the Difference Between an Affidavit and a Statutory Declaration?

While both are legally binding written statements of fact, they are used in slightly different contexts:

  • Affidavits: An affidavit is a written statement sworn or affirmed to be true. They are most commonly used as evidence in court proceedings (such as family law, civil litigation, or estate matters).

  • Statutory Declarations: A statutory declaration is a formal statement made under the Canada Evidence Act or provincial legislation. They have the same legal force as an affidavit but are typically used outside of court settings, such as for government applications, licensing, and corporate requirements.

Your Pre-Visit Checklist: What to Bring

To guarantee a quick and hassle-free appointment at our North York notary clinic, please make sure you have the following ready before you arrive:

Your Unsigned Paperwork

Fill out your forms completely, but wait to sign them. It is a strict legal requirement that your signature is applied directly in front of our Notary Public or Commissioner of Oaths while you swear or affirm the contents.

Current Government-Issued ID

We need to legally verify who you are. Please bring a valid, unexpired piece of photo identification, such as your Canadian Passport, provincial Driver’s License, or Ontario Photo Card.

Referenced Exhibits (If Needed)

Does your statutory declaration or affidavit mention attached proof, such as printed emails, financial statements, or photos? You must bring the physical copies of these exhibits so the notary can properly stamp and bind them to your main document.

Frequently Asked Questions About Affidavits & Declarations

You are welcome to bring your own fully prepared documents for us to commission. However, if you need help, we offer custom drafting services for common forms like OSAP declarations, vehicle gift transfers, and travel consent letters. If your affidavit is for a complex legal or family court case, we recommend having your own legal counsel draft it before bringing it to our North York office to be sworn.

Unfortunately, no. Under Ontario law, a statutory declaration or affidavit must be signed directly in the physical presence of a Commissioner of Oaths or Notary Public. If you signed it before arriving, we will simply ask you to cross out the original signature and re-sign the document while in front of us.

An oath is a formal, religious pledge to tell the truth, traditionally taken while holding a sacred text like the Bible or Quran. An affirmation is a secular, non-religious promise to tell the truth. Both carry the exact same legal weight in Canada, and you are free to choose whichever option you are most comfortable with during your appointment.

If your sworn statement refers to supporting documents—known as exhibits (such as printed emails, bank statements, or photographs)—you must bring the physical copies with you. Our notary will review, stamp, and sign each individual exhibit to legally tie it to your main document. Please note that each exhibit stamp counts as an additional notarization on our fee schedule.

Yes! The Law Society of Ontario permits the remote commissioning of affidavits and statutory declarations. You can book an Online Remote Notary appointment with us and complete the entire process from home via a secure video call.

Walk-ins are absolutely welcome at both our Keele & Finch and York Mills locations. However, to guarantee you are seen right away without any wait time, we highly recommend booking a quick appointment through our website before you head over.
